Welcome to ScoreKeeperCo, a service dedicated to providing scorekeeping and leaderboard management software. These Terms of Service ("Terms") govern your access to and use of our website and software application (the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you should not access or use the Service.
ScoreKeeperCo offers a platform for users to create and manage scoreboards and leaderboards for various events and competitions. We strive to provide a reliable and effective service but make no guarantees regarding the outcome or success of events managed using our Service.
ScoreKeeperCo may display advertisements on its platform, which may be targeted to the content or information on the platform, queries made through the platform, or other information. The types and extent of advertising by ScoreKeeperCo on the platform are subject to change. In consideration for ScoreKeeperCo granting you access to and use of the platform, you agree that ScoreKeeperCo, its affiliates, and its third-party providers and partners may place such advertising on the platform or in connection with the display of content or information from the platform whether submitted by you or others.
We do not endorse any products or services offered in any advertising, and we do not control the content of any advertisements or the websites to which the advertisements direct you. The presence of advertising on the platform does not imply an endorsement, sponsorship, or recommendation by ScoreKeeperCo. You should review the advertiser's terms and conditions and privacy policy before engaging with or making purchases from the advertiser.
Our Service is available through different subscription plans, billed on a monthly or annual basis. Payments are processed securely via our third-party payment processor. All financial transactions must be made through approved payment methods.
ScoreKeeperCo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our maximum liability will not exceed the amount you have paid to ScoreKeeperCo in the three months preceding the claim.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. ScoreKeeperCo disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
You agree to indemnify and hold harmless ScoreKeeperCo and its affiliates, officers, agents, and employees from any claim arising from your use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.
These Terms are governed by the laws of the State of Delaware without regard to its conflict of law provisions.
ScoreKeeperCo reserves the right to modify these Terms at any time. We will notify you of significant changes and indicate the date of the latest revision. Your continued use of the Service following the modification of the Terms constitutes your acceptance of the altered Terms.
ScoreKeeperCo reserves the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms. Upon termination, we may delete or deactivate your account and all associated data.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
These Terms constitute the entire agreement between you and ScoreKeeperCo and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and ScoreKeeperCo with respect to the Service.
